1. Agreement

These Terms & Conditions (“Terms”) are an agreement between you and TGSane Technologies (“we”, “us”) about your use of Smart PDF Pilot for Mac (“the app”). By downloading, installing or using the app you agree to these Terms. If you do not agree, do not use the app.

These Terms are our own end-user license agreement for the app. Section 14 contains the minimum terms Apple requires; they apply in addition to the rest of these Terms.

2. Your license

We give you a limited, non-exclusive, non-transferable, revocable license to install and use the app on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The app may also be used by other people in your Family Sharing group, as Apple allows.

The app is licensed, not sold. We keep all rights that these Terms do not give you.

3. Smart PDF Pilot Pro subscription

The app is free to download. Some features, such as saving, exporting, sharing, merging, splitting, extracting pages and password protection, need an active Smart PDF Pilot Pro subscription. The features that need Pro are shown in the app and may change over time.

• Plans and price. Pro is an auto-renewing subscription, billed monthly or yearly. The price, billing period and any free trial are shown on the purchase screen before you confirm, and are set by the App Store for your country.
• Payment. Payment is charged to your Apple Account when you confirm the purchase.
• Renewal. Your subscription renews automatically unless you cancel it at least 24 hours before the end of the current period. Your account is charged for the renewal within 24 hours before the end of the current period, at the price of your plan.
• Free trial. If a free trial is offered, any unused part of the trial is forfeited when you buy a subscription, where applicable.
• Managing or canceling. Manage or cancel your subscription in your Apple Account settings at apps.apple.com/account/subscriptions. Deleting the app does not cancel it.
• Refunds. Apple handles all payments, so we cannot issue refunds ourselves. You can ask Apple at reportaproblem.apple.com.
• Price changes. If the price changes, Apple will tell you and, where the law requires it, ask for your consent. If you do not agree, cancel before the change takes effect.
• Restoring. To use Pro on another Mac signed in with the same Apple Account, choose Restore Purchases in the app.
• When a subscription ends. Pro features stop working. Your documents are not affected: they are your files on your Mac.

4. Your documents and your responsibilities

You own your documents. We do not access, copy or store them (see our Privacy Policy Policy). You are responsible for having the right to open, edit and share the documents you use with the app.

Editing a PDF can change it in ways that are hard to predict. Saving writes over the file you opened, and some edits rewrite a page’s contents. Keep a copy of important originals, check the result before you share it, and use Undo if something looks wrong. You are responsible for backing up your files.

5. Redaction, protection and sensitive information

The app offers features such as redaction, password protection and watermarks. Please use them carefully:

• Covering text with a box or edit does not always remove the original text from the file. The app tells you when an edit only covers the old text. To remove information permanently, use Redact and then check the saved file yourself, for example by searching it and trying to select the text.
• Password protection uses the PDF format’s own encryption. How strong it is depends on the password you choose and on the program that opens the file. We cannot recover a lost password.
• Watermarks deter casual copying. They do not prevent it.

We do not guarantee that any of these features will meet your legal, regulatory or confidentiality needs. Always verify the output before you rely on it.

6. Acceptable use

You agree not to:

• use the app to break the law or to infringe anyone’s rights;
• copy, modify, sell, rent, lend or distribute the app, or create works based on it, except as the law or these Terms allow;
• reverse engineer or try to extract the app’s source code, except where the law gives you that right despite this restriction;
• get around or interfere with the subscription, licensing or security features of the app.

7. Intellectual property and open-source software

The app, its design, name and content belong to TGSane Technologies and its licensors, and are protected by copyright and other laws. These Terms give you no ownership of them.

The app includes open-source software, such as PDFium, which is licensed under its own terms. Those licenses are listed in the app under Help > Acknowledgements. Nothing in these Terms limits your rights under them.

If you send us feedback or suggestions, we may use them without owing you anything.

8. Updates and support

We may update the app, add, change or remove features, and release new versions. Some updates may be needed to keep using the app. For help, contact us at support@tgsane.com. We try to reply promptly but do not promise a response time.

9. Disclaimer of warranties

To the fullest extent the law allows, the app is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise that the app will be uninterrupted or error-free, or that it will produce a particular result with every PDF file.

Some places do not allow certain warranties to be excluded, so some of this may not apply to you. Your legal rights as a consumer are not affected.

10. Limitation of liability

To the fullest extent the law allows, TGSane Technologies will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, documents, profits or goodwill, arising from your use of the app. Our total liability for all claims relating to the app is limited to the greater of the amount you paid for the app in the 12 months before the claim and USD 50.

Nothing in these Terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, for fraud, or your statutory consumer rights.

11. Your responsibility for misuse

If your use of the app in breach of these Terms causes a third party to bring a claim against us, you agree to cover our reasonable losses from that claim, to the extent the law allows.

12. Ending these Terms

You can stop using the app at any time by deleting it and canceling any subscription. We may end your license if you break these Terms. When the license ends, you must stop using the app. Sections 4 to 7 and 9 to 13 continue to apply afterwards.

13. Governing law

These Terms are governed by the laws of YOUR COUNTRY OR STATE, without regard to its conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the place where you live, and any rights you have to bring a claim in your local courts.

14. Terms required by Apple

You and TGSane Technologies acknowledge the following.

1. Agreement with us, not Apple. These Terms are between you and TGSane Technologies only, not Apple. TGSane Technologies, not Apple, is solely responsible for the app and its content. If these Terms are less restrictive than the Usage Rules in the Apple Media Services Terms and Conditions, the Usage Rules apply.
2. Scope of license. Your license is limited to a non-transferable license to use the app on Apple-branded products that you own or control, as the Usage Rules allow, except that the app may also be used by other accounts connected to the purchaser through Family Sharing or volume purchasing.
3. Maintenance and support. TGSane Technologies is solely responsible for any maintenance and support for the app. Apple has no obligation to provide any.
4. Warranty. If the app does not meet any applicable warranty, you may tell Apple, and Apple will refund the purchase price. To the maximum extent the law allows, Apple has no other warranty obligation for the app. Any other claim, loss, liability, damage, cost or expense caused by the app not meeting a warranty is TGSane Technologies’ responsibility.
5. Product claims. TGSane Technologies, not Apple, is responsible for any claims about the app or your use of it, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and consumer protection, Privacy Policy or similar claims.
6. Intellectual property claims. If a third party claims that the app or your use of it infringes their intellectual property rights, TGSane Technologies, not Apple, is solely responsible for investigating, defending, settling and discharging the claim.
7. Legal compliance. You confirm that you are not located in a country that is subject to a US Government embargo or that the US Government has designated a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
8. Developer contact. Questions, complaints or claims about the app can be sent to TGSane Technologies, BUSINESS ADDRESS, support@tgsane.com.
9. Third-party terms. You must follow any applicable third-party terms when you use the app, for example those of your internet provider.
10. Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept them, Apple will have the right (and is considered to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

15. Changes to these Terms

We may update these Terms from time to time. We will change the date at the top of this page, and for important changes we will tell you in the app’s update notes. If you keep using the app after a change, you accept the new Terms. If you do not agree, stop using the app.
